1. License to Use the Services
Subject to your compliance with these Terms, Kivonix grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use our applications on a mobile device that you own or control, solely for your personal, non-commercial entertainment and utility purposes.
2. Restrictions on Use
You agree that you will not, under any circumstances:
- Copy, modify, translate, adapt, or otherwise create derivative works or improvements of the Services.
- Reverse engineer, disassemble, decompile, decode, or attempt to derive or gain access to the source code of the applications.
- Remove, delete, alter, or obscure any trademarks or any copyright, trademark, patent, or other intellectual property or proprietary rights notices from the Services.
- Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with our games.
- Use the Services for any unlawful purpose or in any manner inconsistent with these Terms.
3. In-App Purchases and Virtual Items
Our applications may include virtual currencies, items, or premium features ("Virtual Items") that can be purchased with real-world money through the Google Play Store.
- No Real-World Value: Virtual Items have no real-world monetary value and cannot be exchanged for real money, goods, or services from Kivonix or anyone else.
- Final Sales: All purchases of Virtual Items are final and non-refundable, except as required by applicable law or the refund policies of the Google Play Store.
- Google Play Policies: All transactions are processed by Google Play. Kivonix does not process payments directly and is not responsible for billing errors.
4. Intellectual Property Rights
All rights, title, and interest in and to the Services (including without limitation any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, concepts, artwork, animations, sounds, musical compositions, and audio-visual effects) are owned by Kivonix or our licensors. You acknowledge that you do not acquire any ownership rights by using the Services or by purchasing Virtual Items.
5. Disclaimer of Warranties
THE SERVICES ARE PROVIDED TO YOU "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted under applicable law, Kivonix expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Services, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KIVONIX, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.
7. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
